Do I need an Isle of Man Grant of Probate?
We can submit an application for a formal grant. If the court approves it, this will give the executor or administrator the necessary authority to handle debts and collect and divide any remaining assets.
Can you reseal a UK probate or other foreign probate in the Isle of Man?
No, it is not possible to reseal a Grant of Probate or Letters of Administration in the Isle of Man. A new probate application is required to deal with the assets of a deceased person located in the Isle of Man.
Can I make the application personally from overseas?
The application for the grant of probate should be made by the Executor or Administrator of the estate or appointed agent (such as a law firm)
The Isle of Man however has a requirement that the application should be submitted from an address within the Isle of Man.
This therefore prevents any individual from outside the Isle of Man applying for Probate.

There are two types of application which can be used depending on the circumstances:
Grant of Probate
Where there is a Will, it will name the executor. The executor will then need to apply for a grant of probate. This gives the names person the authority to deal with the administration of the estate.
Grant of Letters of Administration
Where no Will has been written the next of kin or a close relative will need to apply for grant of letters of administration. These letters can then give the authority needed to deal with the administration of the estate.
How to obtain Probate or Letters of Administration in the Isle of Man
In order to make an application for Probate, the following will need to be provided to the Probate court:
- Details of the value of the estate of the deceased in the Isle of Man only. (The courts are not interested in all of the deceaseds’ assets)
- An original copy of the death certificate (a copy certified by a third party will not be accepted).
- The Original Will or a Court Sealed Copy should the Will have already been submitted to Probate in another country.
- If you already have a Grant of Probate or equivalent from another country an original or Court sealed copy.
What about documents not in English?
Should any of the above documents not be in English, the Courts require an official translation of the same.
What if there is no Will?
If there is no Will, an affidavit may additionally be required to set out for the Courts the beneficiaries and who is entitled to administer the estate.
What are the Court Fees?
The court fee depends on the value of the estate as follows:

If the only asset is one policy of life assurance which exceeds £50,000.00 and the policyholder resides outside of the Isle of Man, the court fees are £279.50.
Timescales
Some believe applying for Probate to be a timely process, but not at MannBenham. We will be on hand with an expert team and once the paperwork has been prepared and submitted to the Courts, the Courts estimate that they will issue your Grant of Probate with 20 working days.
Once issued by the Court – Can I administer and finalise an estate personally for overseas?
Yes, once the application has been issued by the Courts, the Executor or administrator will be given the necessary authority to handle debts and collect and divide the assets of the deceased in accordance with the Will or intestacy rules.
